Montezuma County has received an increasing number of complaints from the public about trash and junk on private properties in the county.
The Board of Montezuma County Commissioners is considering an ordinance targeting trash and junk, which is called “rubbish” in the statute
(CRS 30-15-401(a)(I)(A)). Such an ordinance would allow county code enforcement officers to issue citations for accumulation of junk and trash
in violation of the ordinance and require its removal.
By statute, such an ordinance cannot apply to agricultural properties in agricultural use, or to industrial parcels of greater than 10 acres.
If the junk is not removed within a reasonable time, the ordinance would give the county the authority to petition the court for an order
authorizing the county to remove the junk and assess the property owners with a bill for the costs incurred.
